After serving three terms as a Birmingham City Councilor, Carole C. Smitherman, Esq., verbalized her resignation on Tuesday, January 15, 2013. "Now, with the people’s permission, this is the best time to return to my service on the bench. The City and district are progressing well and for that I am thankful," said Smitherman. Her new role, Jefferson County Circuit Court Judge, Place 13.

During her time at Birmingham City Hall, Smitherman served as Council President, Council President Pro Tempore, Chair of Budget and Finance, Chair of Economic Development, Chair of Utilities and Interim Mayor.
As Council President, Smitherman is credited with creating the formula for an Alternative Birmingham City Court Practice and Municipal Judge Reform; creating the Neighbor to Neighbor Initiative to supply food, clothing and toys to needy families during the holiday seasons; and initiating Economic Development Summits that involved a broad cross section of the community to ascertain important issues, concerns and challenges facing small businesses and the corporate sectors.
In 2004, she invited her childhood friend, former U.S. Secretary of State Dr. Condoleezza Rice, to return home to Birmingham. Secretary Rice was the guest speaker at the Tragedy to Triumph Program which honored the Four Little Girls killed in the 1963 church bombing. It was a historic moment that attracted national and international news media to Birmingham including the BBC, CNN, MSNBC, The New York Times and The Washington Post.
During the years she has served on the Council, she has demonstrated a commitment to the children of Birmingham. She established an oratorical contest to motivate students to develop language proficiency. Also to her credit is a program called "Children of the Village," founded to help students acquire skills that are necessary for success in life. Smitherman supported Strings for Kids to ensure that children in District 6 would have access to classical music training which has a positive effect on academic performance.
Smitherman is an accomplished attorney with nearly 20 years experience. She has served as the first female Birmingham Municipal Court Judge and the first African-American in the State to serve as a Circuit Judge. She has nearly 30 years service to the Alabama Bar.
She is married to State Senator Rodger Smitherman, the former President Pro Tempore of the Alabama Senate, and together they have four children.
